New Business Ron Eliason submitted a news article concerning a court settlement against Sagamore Hills Township and in favor of a township woman over a domestic issue. Mr. Eliason stated that the article re-affirms the information concerning the first amendment rights of citizens received from Judge Cannon at the NEO Zoning Seminar he attended in June 2008. Mr. Eliason believes it is important that the Township respect property owners and their property rights when writing zoning language, and the day to day enforcement of the Zoning Resolution.
Mr. Eliason requested the opinion of the Commission on HB 244 concerning cable relocation for residents of the township. Mrs. Welch stated that the Trustees have not addressed the issue at their meetings. Mr. Eliason stated that the burying of the cables would eliminate the utility poles along the roadways, and reduce property damage from vehicles hitting the poles.
Land Use Planning Survey
Mrs. Fraser received an e-mail from Keith McClintock, dated July 7, 2008, requesting an informal review by the Commission of the draft copy of the Hambden Township Land Use Plan Survey. Mr. McClintock requested the comments of the Commission to be submitted by September 2, 2008. The Commission reviewed the draft copy, and their comments were noted in the margins. The marked copy of the draft will be forwarded to Trustee McClintock and the Hambden Township Comprehensive Planning Committee.
Old Business Rewrite - Pending Items
Mrs. Welch submitted proposed changes to the Zoning Resolution from the Zoning Department for the Zoning Commission's review. Copies of the proposed changes were also submitted by the Zoning Inspector's Office to the Geauga County Planning Commission for its informal review, Mrs. Welch mentioned. Mrs. Fraser stated that the Zoning Commission's Pending Items Action Plan has been updated to include the Zoning Department's proposed changes and the changes to the "Lead" persons.
Storage Units Mrs. Cox reported that she did call the Geauga County Planning Commission concerning the possibly of eliminating or changing the zoning requirements for mini-storage units, and requesting sample regulations from other townships regarding mini-storage units. As of today, Mrs. Cox stated that she has not received any information, and will look into the matter with Mr. Dietrich.
Temporary Signs Mrs. Fraser updated the Commission on the proposed changes to Article VII Signs which includes the new definition for "Temporary Signs". Mrs. Fraser requested the Commission to review the working draft pages for logic and structure, and be prepared to discuss this matter at the next scheduled meeting.
Miscellaneous
Mrs. Welch requested the Commission's opinion on a zoning matter. Property owner Clyde Groves is requesting an opinion from the Zoning Department on whether he is allowed to destroy an existing nonconforming garage and replace it with a conforming garage. Mr. Groves would also like to construct a permanent picnic shelter. The property currently does not have a residential dwelling. The residential dwelling was destroyed by fire a number of years ago. Mrs. Welch's belief was that a permanent dwelling must exist prior to construction of an accessory building, or a variance would have to be obtained. The Commission agreed with Mrs. Welch's opinion.
